Welcome to Writik. These Terms of Service ("Terms") govern your access to and use of Writik's language learning service accessible at writik.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Writik is operated as a sole proprietorship from Ontario, Canada.

1. Service Description

Writik is an AI-powered language learning platform that helps users improve their writing skills through translation exercises, intelligent evaluation, and adaptive feedback. The Service offers:

• Free Plan: 10 AI-generated questions per day for authenticated users, 3 questions per day for guest users
• Premium Plan: 100 AI-generated questions per day, early access to new features, for $3 USD per month
• Support for 8 languages: Spanish, French, German, Italian, Portuguese, Chinese, Japanese, and Korean

2. Account Registration and Use

2.1 Guest Users

You may use the Service without creating an account ("Guest Mode"). Guest users are limited to 3 questions per 24 hours per session, with an additional IP-based limit of 10 questions per 24 hours to prevent abuse.

2.2 Authenticated Users

To access the full Free plan or subscribe to Premium, you must create an account by signing in with Google OAuth. By creating an account, you represent that:

• You are at least 13 years old
• All information you provide is accurate and current
• You will maintain the security of your account

3. Premium Subscription Terms

3.1 Pricing and Billing

• Premium subscriptions cost $3.00 USD per month
• Billing is handled by Stripe, Inc., a third-party payment processor
• Subscriptions automatically renew monthly unless canceled
• Applicable taxes (HST for Ontario, Canada; other taxes based on your location) will be added at checkout
• You authorize us to charge your payment method on file for recurring monthly charges

3.2 Cancellation

You may cancel your Premium subscription at any time through your account settings or the Stripe Customer Portal. Upon cancellation:

• You will retain Premium access until the end of your current billing period
• Your subscription will not automatically renew
• After the billing period ends, you will be automatically downgraded to the Free plan

3.3 Refund Policy

All sales are final. We do not offer refunds for Premium subscriptions, whether partial or full. You may cancel your subscription at any time to prevent future charges, but you will not receive a refund for the current billing period.

3.4 Price Changes

We reserve the right to change our subscription prices at any time. If we increase the price of Premium subscriptions, we will provide you with at least 30 days' notice before the price change takes effect. Continuing your subscription after the price change constitutes acceptance of the new price.

4. Usage Limits and Fair Use

Daily question limits are enforced to ensure fair access and prevent abuse:

• Limits reset every 24 hours based on your first question in the current period
• Unused questions do not roll over to the next day
• Attempting to circumvent rate limits (e.g., creating multiple accounts, using VPNs to rotate IP addresses) is prohibited and may result in account suspension or termination

5. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its systems
• Use automated scripts, bots, or other means to access the Service beyond normal human interaction
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Submit content that is offensive, harmful, defamatory, or violates the rights of others
• Interfere with or disrupt the Service or servers/networks connected to the Service

6. Intellectual Property

6.1 Service Content

The Service, including its design, features, text, graphics, and software, is owned by Writik and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of any content you submit to the Service (your translations and answers). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

7. Service Availability and Changes

We strive to provide reliable service, but:

• The Service is provided "as is" without warranties of any kind
• We may modify, suspend, or discontinue any part of the Service at any time
• We may experience downtime for maintenance, updates, or unforeseen technical issues
• We are not liable for any loss or damage resulting from service interruptions

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be error-free, uninterrupted, secure, or accurate. AI-generated content may contain errors or inaccuracies. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRITIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

10. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users, us, or third parties
• Violates applicable laws or regulations
• Involves fraudulent or suspicious payment activity

You may delete your account at any time through your account settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, provide additional notice (such as on our homepage or via email). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Ontario, Canada.
